Legislation 

1)  The first EU Legislation 1999/13/EC, "The Solvent Emissions Directive" (SED), set out the EU rules to limit solvent emissions from many industrial processes. The rules are appropriate for large-scale industrial processes, but do not work well in small-scale industries such as Refinish.

2)  In recognition of this, EU has passed a new Directive, 2004/42/CE, "The Paints Products Directive" (PPD), which governs solvent emissions from the vehicle repair facilities (and Decorative Paints).
3)  The new EU Directive removes vehicle repair facilities from the SED at EU level. The PPD has product-based VOC limits. There is now visibility of the VOC regime that will govern the EU until beyond 2010. The PPD needs to be enacted by all member states before 30/10/05 and be active by 01/01/07.

4) There is some flexibility allowed for member states in how the PPD is implemented nationally but these interpretations cannot interfere with free trade.



How do I identify  VOC Compliant Products?
 

As part of the legal requirements for the implementation of the PPD, many products will have their label modified to show compliance. This will take the form of a VOC indicator on the label to show the category that the product falls into and confirm the compliance of the product.

However, the legal requirements do not cover all products that can be used from 2007.

Hardeners, Thinners and products that are out of scope of the directive (e.g. plastic primers) do not require this labelling modification, but can still be used for vehicle repair.

In order to clearly identify those products that can be used as part of the compliant range, a simple graphic of a Globe has been added to the labels of all products that fit this category.

These new labels were phased in during 2006, ready for the 2007 deadline.

• The onus is on the bodyshop to comply


• A number of ways may be used to achieve compliance (abatement systems; Solvent Reduction Plan). Note: Product-based VOC limits are not prescribed at EU level.


• Only bodyshops above a certain threshold of solvent usage will be affected. The threshold depends on solvent use activity (e.g. Vehicle Refinish: 0.5 tonnes/year; LIC 5 tonnes/year).
• The onus is on the paint manufacturer or importer to place compliant products on the market.


• Only product-based VOC limits.



• VOC contents must be printed on the labels to clearly identify the compliant products.

• No threshold (all customers covered).
• The user must keep records of VOC usage and prove that the activity is compliant.

• Active in all Member States (only since 2004 in some)

•For bodyshops using the Reduction Scheme there are two stages: For new or substantially changed premises: Stage 1, since 31/10/01; Stage 2, by 31/10/04. For existing premises: Stage 1 by 31/10/05; Stage 2 by 31/10/07
• No need to record or prove compliance by the end user.


• Passed EU Parliament 21/04/04



• Must be brought into force by Member States by 30/10/05.



• Product-based VOC limits apply from 01/01/07
